AMENDED – CSUEU Election Extension Ballot

To: CSUEU Members

Re: AMENDED – CSUEU Election Extension Ballot

PLEASE DISREGARD THE PREVIOUS BALLOT PACKAGE YOU RECEIVED

The recent ballot mailed to members was incorrect. It erroneously listed the options the Board had to consider before its final recommendation was made and that recommendation is the subject of the ratification vote. The corrected ballot will be mailed out approximately August 11.

As explained in the previous letter, as well as in letter you will receive with this new ballot, you will be voting either YES or NO to ratify the CSUEU Board of Directors’ decision to extend the current officers’ term and hold elections in 2012.

If you still have the first mailing, please discard it. If you mailed it in already, it will not be counted and will be discarded. The deadline for you to submit your vote has been extended. The new deadline is: Friday – September 10th. We apologize for any inconvenience or confusion this has caused.

Governor Orders New State Worker Furloughs

CSU employees won't be impacted

As this July 28 San Francisco Chronicle article outlines, the governor has ordered a new round of furloughs for state civil service employees. However, the order doesn't extend to CSU employees, because, unlike many other state agencies, CSU and other public higher education segments generally are not under the direct executive authority of the governor. The CSU Chancellor Charles B. Reed released a statement confirming that CSU employees will not be subject to these state mandated furloughs

Minimum Wage Issue

On July 1, 2010, Gov. Schwarzenegger made public an executive order that could temporarily reduce pay for more than 200,000 state workers to the federal minimum wage of $7.25 per hour. According to the union's preliminary review, the executive order does not apply to CSU staff or to other CSU employees.

Unlike many other state agencies, the CSU and other public higher education segments generally are not under the direct executive authority of the governor.

State Controller John Chiang, whose office issues state paychecks, released a statement saying that he won't follow the order unless a court tells him to. On July 2 the California Court of Appeal, looking at a similar executive order from 2008, held that Schwarzenegger had the authority to issue such an order. Again, to the best of our knowledge, these orders do not apply to CSU staff or to other CSU employees. Chiang can -- and likely will -- seek a review of the appellate court decision by the California Supreme Court in the coming days and weeks.

We are in contact with the California State University Chancellor's Office to get an official response from them on the issue. Once we hear anything we will update you.

For their part, members of the state legislature have adjourned for summer recess.
